NOAKHALI IX will not assign or provide any IP addresses, AS numbers, etc. Peering member will have to have their own arrangements with APNIC for this.
NOAKHALI IX is not an ISP and will not provide any Internet connections or Transit services. Members should have full Internet connectivity independent of NOAKHALI IX facilities.
Member needs to bring its physical connectivity up to NOAKHALI IX ODF through dedicated leased lines (Fiber Optics connection preferred) of sufficient capacity. Payments made to carriers for the leased link (NTTN) will be directly between them and the ISPs and NOAKHALI IX will not be a party to it, except for ensuring technical compatibility.
Member shall provide their own required equipment’s (routers, media converters and cable) to connect with NOAKHALI IX switch.
The NOAKHALI IX must not be used as the primary connection (Gateway) to the global Internet.
Peering ISPs will not be allowed to have NOAKHALI IX facilities as a default route. Further, no ISP should use NOAKHALI IX to carry traffic between its own two or more routers.
After successful completion of all formalities connection will be established within 10 days from the date of application.
NOAKHALI IX is a settlement-free interconnection point. In other words, no settlement is to be paid by the peering participants for the incoming and outgoing traffic. All participants should not filter traffic or routing table entries to or from any other participants. NOAKHALI IX will a port and a single per port. NOAKHALI IX will not provide any other IP or ASN to any member.
Regulatory and Legal:
To complete the formalities member must submit all copy of updated legal documents like trade license, ISP license etc along with the application form.
NOAKHALI IX will not be responsible for any content of members being transmitted through NOAKHALI IX network.
Member will be solely responsible for violation of the conditions of it’s ISP License issued to it by the Bangladesh Telecommunication Regulatory Commission (BTRC), under which they are authorized to provide Internet Services.
Monthly membership fee (port charge) is applicable for all members as set by BTRC and mentioned in the website of NOAKHALI IX. All Payment should be made by account payee check or online bank transfer to NOAKHALI IX bank account only.
No personal or private cash transaction is acceptable in any phase of payment process. NOAKHALI IX do not charge any fees for installation and any modification (relocation/ up gradation/ down gradation) of its services.
For new connectivity, member must attach the payment slip of the first month along with the application form.
Invoicing is done on a monthly basis unless member chooses for an annual payment method for which a 5% discount applies. Billing starts from the date of commencement of the connectivity.
Payment must be made within 10 days of the month. A member not paying membership fee consequently for 2 (two) months will be disconnected without any prior notice or intimation.
Price is excluding VAT and all applicable taxes will be over and above these rates. If member pays VAT from their end the copy of VAT challan (Mushok- 6.3) must be provided to NOAKHALI IX with the payment.
Money Receipt must be kept for future reference.
Both parties have the right to terminate the agreement at any time during the agreement period by giving thirty (30) days prior written notice to the other party which will be effective from the 1st day of the next month.
NOAKHALI IX reserves the right to temporarily disconnect any member for security (Internet Security or threat to State Security) reasons or preserving the stability of NOAKHALI IX infrastructure.
These terms and conditions may change from time to time. NOAKHALI IX reserves the right to amend the terms and conditions stated above any time as per the need of the IX community and approval of the NOAKHALI IX Trust.
Member must confirm the final date of termination by email or sending a notice to NOAKHALI IX administration and must clear all previous dues before the termination being commenced.
Up gradation/ down gradation:
Member may upgrade or downgrade its connectivity by submitting a separate application before 15 days. Billing for the changed port price will be affective from the first day of the new month. For up gradation member must submit a separate application form and clear all previous dues (if any).
For redundant connectivity a separate form should be filled up and 50% of the regular port charge will be charged to members. For redundant connectivity member must submit a separate application form and clear all previous dues (if any).
For establishment of re-connection member must submit a new application form and clear all previous dues (if any).
To avail different CDN services offered by NOAKHALI IX a separate agreement should be signed and a separate tariff model may be applicable for this purpose as per the direction of BTRC. For CDN services member also has to clear all previous dues (if any).
